US rejects France probe into Musk’s X

–Washington declines to assist French criminal investigation, citing free speech concerns and First Amendment protections

WASHINGTON: The United States Department of Justice has refused to assist a French criminal investigation into X, escalating a transatlantic dispute over online speech regulation and platform accountability.

In a letter sent to French authorities, the DOJ’s Office of International Affairs said it would not facilitate the probe, arguing it risked undermining protections guaranteed under the First Amendment of the US Constitution. The department described the French effort as an attempt to regulate “a public square for free expression” through criminal law, according to a report by The Wall Street Journal.

The investigation by French prosecutors targets the platform owned by Elon Musk, focusing on alleged algorithmic bias, potential foreign interference in elections, fraudulent data practices, and concerns around content moderation and artificial intelligence tools such as deepfakes. Authorities intensified the probe earlier this year, including a police raid on the company’s Paris offices in February.

French prosecutors, however, rejected claims of political motivation and said they were unaware of the specific DOJ communication. They stressed that the judiciary operates independently under the French constitution and that the investigation aims to ensure compliance with national laws governing digital platforms and illegal content.

The dispute reflects widening differences between Washington and European capitals over how to regulate social media companies. The United States has traditionally prioritized free speech protections, while the European Union has moved toward stricter oversight through laws such as the Digital Services Act, which requires platforms to address harmful content and improve transparency.

X has pushed back strongly against the French probe, calling it politically driven and refusing to share details of its recommendation algorithms or real-time user data. The company argues that such demands could expose proprietary systems and threaten user privacy and freedom of expression.

The platform, formerly known as Twitter before Musk’s acquisition in 2022, has faced increased scrutiny globally over its content policies and moderation practices. Since the takeover, X has reduced parts of its trust and safety teams and shifted toward a more permissive approach to speech, drawing criticism from regulators and civil society groups.

According to industry estimates, X serves hundreds of millions of users worldwide, making it a central arena for political discourse and information exchange. Concerns over misinformation and foreign influence campaigns have intensified in recent years, particularly during election cycles in Europe and the United States.

Legal experts say the DOJ’s refusal to cooperate could complicate cross-border investigations involving technology companies, especially where legal standards on speech and data differ sharply. Mutual legal assistance treaties typically govern such cooperation, but national constitutional protections can limit participation.

Musk is expected to face questioning by French cybercrime investigators in the coming days, adding pressure on the company as it navigates regulatory challenges in Europe. The case could set a precedent for how far governments can go in demanding access to platform data and algorithms.

The standoff underscores a broader clash over digital sovereignty and governance of online spaces. As regulators worldwide tighten oversight of big technology firms, disputes like the one involving X highlight the growing difficulty of balancing national laws with global digital platforms.

The outcome of the case is likely to influence future cooperation between the United States and European authorities on tech regulation, with X remaining at the center of debates over free speech, transparency, and accountability.
